INTRODUCTION
Welcome to H-O-M Social Club, also known as House of Meta Social Club (“H-O-M,” “we,” “us,” or “our”). H-O-M Social Club is an online social network and community platform dedicated to entertainment, technology-infused art, tech-inspired fashion, and technology-related music. Our platform enables registered members to access curated articles, participate in group discussions, share creative content, and connect with a global community of like-minded individuals.
These combined legal documents comprise our Privacy Policy and Terms and Conditions of Use (collectively, “Agreement”). This Agreement governs your access to and use of the H-O-M (aka HOM) Social Club platform, website, mobile applications, and all associated services (collectively, the “Service” or “Platform”).
BY ACCESSING OR USING THE H-O-M SOCIAL CLUB PLATFORM IN ANY WAY, REGISTERING AN ACCOUNT, OR CLICKING “I AGREE,” YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT IN ITS ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL USE OF THE PLATFORM.
This Agreement is applicable globally and is intended to comply with applicable laws across multiple jurisdictions, including but not limited to the United States, the European Union, the United Kingdom, Canada, Australia, and other regions where the Service is accessed.
PART ONE: PRIVACY POLICY
1. Who We Are and How to Contact Us

2. Information We Collect
2.1 Information You Provide to Us
When you register, subscribe, or interact with the Platform, we collect information you actively provide, including:

• Billing information (processed securely through third-party payment processors; we do not store full credit card numbers)
• Profile information such as profile photo, biography, and preferences
• Content you post, publish, upload, or share, including text, images, links, and multimedia
• Communications you send to other users, groups, or to our support team
• Subscription tier and service level selected
2.2 Information Collected Automatically
We automatically collect certain technical information when you access or use the Platform, including:
• IP address and approximate geolocation derived from IP
• Device type, browser type and version, and operating system
• Pages visited, features used, and time spent on the Platform
• Cookies, pixel tags, web beacons, and similar tracking technologies
• Referring URLs and exit pages
• Log files and session data
2.3 Information from Third Parties
If you connect your account to third-party social networks or login services, we may receive profile information in accordance with your authorization and those platforms’ privacy settings.
3. How We Use Your Information
We use the information we collect for the following purposes:
• To create, manage, and maintain your account and provide access to the Platform based on your subscription level
• To process transactions, manage billing, and administer your subscription
• To personalize your experience and deliver content relevant to your interests
• To facilitate group interactions, community features, and social networking functions
• To communicate with you regarding service updates, policy changes, account notices, and promotional materials (subject to your marketing preferences)
• To monitor, detect, investigate, and address violations of this Agreement, including harmful, abusive, or illegal content
• To enforce our Community Standards and content moderation policies
• To cooperate with law enforcement and regulatory authorities where legally required or appropriate
• To improve, analyze, and develop the Platform and its features
• To comply with applicable legal obligations across all jurisdictions in which we operate
4. Legal Bases for Processing (GDPR / UK GDPR)
For users located in the European Economic Area (EEA) or the United Kingdom, we process your personal data under one or more of the following lawful bases:
• Performance of a contract: Processing necessary to provide the Service you have subscribed to
• Legitimate interests: Operating, improving, and securing our Platform; preventing fraud and abuse
• Compliance with a legal obligation: Where processing is required by applicable law
• Consent: Where you have expressly provided consent, such as for marketing communications (which you may withdraw at any time)
• Vital interests: In limited circumstances involving serious safety threats
5. Cookies and Tracking Technologies
We use cookies and similar technologies to operate and improve the Platform, authenticate users, remember preferences, analyze usage, and deliver targeted features. You may manage your cookie preferences through your browser settings or our cookie consent tool. Note that disabling certain cookies may affect the functionality of the Platform.
We comply with applicable cookie consent laws, including ePrivacy Directive requirements in the EU and UK.
6. Sharing of Your Information
We do not sell your personal information. We may share your information in the following circumstances:
• Service Providers: With trusted third-party vendors who process data on our behalf under strict data processing agreements (e.g., payment processors, cloud hosting, email services, analytics providers)
• Legal Authorities: With law enforcement, government agencies, or courts when we are legally required to do so, or when we determine in our sole discretion that disclosure is necessary to protect the safety of any person, prevent fraud or abuse, or respond to legal process
• Child Safety Reporting: We are committed to the protection of minors. Where we identify content or communications that may constitute child exploitation, abuse, or harm, we will immediately report such content to relevant authorities, including the National Center for Missing and Exploited Children (NCMEC), INTERPOL, or relevant national law enforcement bodies worldwide, as appropriate
• Business Transfers: In the event of a merger, acquisition, reorganization, or sale of all or substantially all assets, your information may be transferred, subject to the same privacy protections
• With Your Consent: When you have given us explicit permission to share your information
• Aggregated / De-identified Data: We may share aggregated or anonymized data that does not identify you individually
7. Data Retention
We retain your personal information for as long as your account is active and as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
Important Notice Regarding Data Storage: The H-O-M Social Club Platform is NOT intended to serve as a permanent or indefinite data storage repository. Content, posts, communications, and other materials you upload or share on the Platform are subject to removal at any time, including upon account termination, subscription expiry, or at our sole discretion in accordance with these Terms. You are solely responsible for maintaining independent backups of any content or data you value. WE EXPRESSLY DISCLAIM ALL RESPONSIBILITY FOR ANY LOSS OF DATA, CONTENT, OR MATERIALS STORED OR TRANSMITTED THROUGH THE PLATFORM.
8. Data Security
We implement industry-standard technical and organizational security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit and at rest, access controls, and regular security assessments. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and by using the Platform, you accept this inherent risk.
9. International Data Transfers
H-O-M Social Club is a globally accessible platform. Your information may be transferred to and processed in countries other than your country of residence, which may have different data protection laws. For users in the EEA and UK, such transfers are conducted pursuant to appropriate safeguards, including Standard Contractual Clauses approved by the European Commission, adequacy decisions, or other legally recognized transfer mechanisms.
10. Your Privacy Rights
Depending on your jurisdiction, you may have the following rights with respect to your personal information:
• Right to Access: Request a copy of the personal information we hold about you
• Right to Rectification: Request correction of inaccurate or incomplete data
• Right to Erasure (‘Right to Be Forgotten’): Request deletion of your personal data, subject to certain exceptions
• Right to Restriction of Processing: Request that we limit how we use your data in certain circumstances
• Right to Data Portability: Receive your personal data in a structured, machine-readable format
• Right to Object: Object to processing based on legitimate interests or for direct marketing purposes
• Right to Withdraw Consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights
To exercise any of these rights, please submit a written request to [email protected]. We will respond within the timeframe required by applicable law (generally within 30 days under GDPR and 45 days under CCPA). We may need to verify your identity before processing your request.
11. Jurisdiction-Specific Privacy Rights
11.1 California Residents (CCPA / CPRA)
California residents have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know about personal information collected, sold, or disclosed; the right to delete personal information; the right to opt-out of the sale or sharing of personal information; and the right to limit the use of sensitive personal information. We do not sell your personal information. For California-specific requests, you may designate an authorized agent to submit requests on your behalf.
11.2 EU and UK Residents (GDPR / UK GDPR)
If you are located in the European Economic Area or the United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR as described in Section 10 above. You also have the right to lodge a complaint with your applicable supervisory authority. In the EU, this is the data protection authority in your country of residence. In the UK, this is the Information Commissioner’s Office (ICO).
11.3 Canadian Residents (PIPEDA / Provincial Laws)
Canadian residents have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including the right to access personal information held about you and to challenge the accuracy and completeness of that information.
11.4 Australian Residents (Privacy Act 1988)
Australian residents have rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You may request access to or correction of your personal information by contacting us as described above. You may also lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
11.5 Brazilian Residents (LGPD)
If you are located in Brazil, you have rights under the Lei Geral de Proteção de Dados Pessoais (LGPD), including rights to confirmation of processing, access, correction, anonymization, portability, deletion, and information about sharing, among others.
12. Children’s Privacy
The H-O-M Social Club Platform is intended for users who are at least 18 years of age, or the age of majority in their jurisdiction, whichever is greater. We do not knowingly collect personal information from individuals under the applicable minimum age. If we become aware that we have inadvertently collected personal information from a minor, we will take immediate steps to delete such information and terminate the associated account.
We strictly prohibit any content, communication, or activity on the Platform that exploits, endangers, sexualizes, grooms, abuses, or harms minors in any manner. Violations of this policy will result in immediate account termination and reporting to appropriate law enforcement and child protection authorities worldwide.
13. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by posting the updated policy on the Platform and updating the Effective Date. For significant changes, we may provide additional notice via email or Platform notification. Your continued use of the Platform after such notice constitutes acceptance of the updated Privacy Policy.
PART TWO: TERMS AND CONDITIONS OF USE
14. Acceptance of Terms
By accessing, registering for, or using the H-O-M Social Club Platform in any capacity, you agree to be bound by this Agreement, our Community Standards, and any additional guidelines or policies we may publish, all of which are incorporated herein by reference. If you are using the Platform on behalf of an organization or entity, you represent and warrant that you have authority to bind that entity to this Agreement.
15. Eligibility
To use the Platform, you must:
• Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws of your jurisdiction
• Not have been previously suspended, banned, or removed from the Platform by us
By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify eligibility and to refuse service to any person who does not meet these requirements.
16. Account Registration and Security
To access certain features of the Platform, you must register for an account. You agree to:
• Provide accurate, current, and complete information during registration and keep your account information up to date
• Maintain the security and confidentiality of your login credentials and not share your account with others
• Notify us immediately of any unauthorized use of your account or any suspected security breach
• Be solely responsible for all activities that occur under your account
We reserve the right to reclaim, suspend, or terminate usernames that violate this Agreement or that we determine, in our sole discretion, are inappropriate.
17. Subscription Tiers and Service Levels
H-O-M Social Club offers the Platform on a tiered subscription basis. The features, functionality, content access, and privileges available to you depend on your current subscription tier. We reserve the right to modify, add, or remove features associated with any subscription tier at any time, with reasonable notice where practicable.
Subscription fees, billing cycles, and payment terms are set forth in the applicable subscription plan you select at the time of enrollment. All fees are non-refundable except as required by applicable law or as otherwise stated in our refund policy. We use third-party payment processors and do not directly store your full payment credentials.
Free-tier users acknowledge that their access is provided at our discretion without consideration and may be modified, limited, or discontinued at any time without notice or liability.
18. Community Standards and Acceptable Use
18.1 General Conduct
As a condition of use of the H-O-M Social Club Platform, ALL users—regardless of subscription tier—are required to engage with each other and with the Platform in a professional and respectful manner at all times. This requirement is fundamental to the H-O-M Social Club experience and is non-negotiable. Failure to comply with this standard constitutes a material breach of this Agreement and may result in immediate account suspension or termination.
18.2 Strictly Prohibited Content and Conduct
The following content, communications, and behaviors are STRICTLY PROHIBITED on the H-O-M Social Club Platform:
• Any content, communication, material, or activity that harms, endangers, exploits, sexualizes, abuses, grooms, or is otherwise harmful to minors (individuals under 18 years of age or the applicable age of majority)
• Any content, communication, or activity that promotes, depicts, encourages, or facilitates animal cruelty, abuse, or harm
• Any content, communication, or activity that harasses, threatens, intimidates, abuses, defames, or incites violence against any person or group of people
• Hate speech, discrimination, or content that promotes or glorifies hatred based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic
• Content that violates or infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party
• Spam, unsolicited commercial communications, phishing, or any form of fraudulent activity
• Content containing malware, viruses, or any malicious code
• Impersonating any person, entity, or organization, or misrepresenting your affiliation with any person or entity
• Any activity that violates applicable local, national, or international law or regulation
• Posting private personal information of others without their consent (doxxing)
• Content depicting graphic violence, gore, or disturbing material
• Unauthorized use of another user’s account or login credentials
18.3 Content Moderation and Enforcement
Zero Tolerance Policy: We maintain a strict zero-tolerance policy regarding content or communications that harm, exploit, or endanger children, animals, or people. Any content that violates this policy will be removed immediately upon discovery.
Upon discovery of any prohibited content or conduct, we reserve the right, in our sole and absolute discretion, to take any or all of the following actions without prior notice or liability:
• Remove, disable access to, or permanently delete any content, post, communication, profile, or account-related information we determine, in our sole discretion, to be in violation of this Agreement or our Community Standards
• Immediately suspend or permanently terminate your account and all associated access without refund
• Report the content and associated user information to relevant law enforcement agencies, regulatory authorities, child protection organizations (including NCMEC), or animal welfare authorities, as we determine appropriate in our sole discretion
• Cooperate fully with any law enforcement investigation arising from content or conduct on the Platform
• Pursue any and all legal remedies available to us
You acknowledge and agree that our content moderation decisions are made at our sole discretion and that we are not obligated to provide explanations for enforcement actions taken.
19. Intellectual Property
19.1 Our Intellectual Property
The H-O-M Social Club Platform, including all content provided by us (such as articles, graphics, logos, interface design, software, and other materials), is owned by or licensed to H-O-M Social Club and is protected by applicable intellectual property laws worldwide. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit our intellectual property without our express written permission.
19.2 Your Content
You retain ownership of original content you create and post on the Platform. By posting content on the Platform, you grant H-O-M Social Club a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, transmit, display, and distribute your content in connection with operating and promoting the Platform and our services. This license continues for a commercially reasonable period following removal of your content or termination of your account.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the above license, and that your content does not violate any third-party rights or applicable law.
19.3 Takedown Notices
If you believe that content on our Platform infringes your copyright or other intellectual property rights, please submit a notice to our designated agent at [email protected] with all information required under applicable law (including the Digital Millennium Copyright Act in the US, the Copyright Directive in the EU, and equivalent laws in other jurisdictions).
20. Our Right to Modify or Terminate Service
IMPORTANT: BY ENLISTING IN AND USING THE H-O-M SOCIAL CLUB SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE that we reserve the absolute right, in our sole and complete discretion, to:
• Modify, suspend, restrict, or discontinue any aspect of the Service, including features, content availability, and functionality, at any time and for any reason or no reason
• Remove, edit, or delete any of your posted content, communications, profile information, or any related materials at our sole discretion, without notice and without any obligation or liability to you
• Suspend or terminate your account and access to the Platform at our sole and complete discretion, with or without cause, and without prior notice
• Remove any and all of your data, content, posts, communications, and account information from the Platform at any time
YOU AGREE THAT H-O-M SOCIAL CLUB SHALL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF DATA, CONTENT, COMMUNICATIONS, OR OTHER INFORMATION RESULTING FROM OR RELATED TO ANY SUSPENSION, TERMINATION, REMOVAL, OR MODIFICATION OF YOUR ACCOUNT OR ANY CONTENT, REGARDLESS OF THE REASON THEREFOR.
21. Data and Storage Responsibility
THE H-O-M SOCIAL CLUB PLATFORM IS NOT INTENDED TO SERVE AS A PERMANENT, LONG-TERM, OR INDEFINITE DATA STORAGE SOLUTION. By using this Platform, you expressly acknowledge and agree to the following:
• You assume full and complete responsibility for all data, content, and materials you submit, upload, post, or transmit through the Platform
• We make no representations or warranties regarding the preservation, availability, or longevity of any data or content on the Platform
• We expressly disclaim all liability for any loss, corruption, deletion, or unavailability of any data, content, or materials, whether arising from technical failures, account termination, enforcement actions, or any other cause
• You are solely responsible for maintaining independent backups of all content and data you consider valuable
• The Platform is intended as a temporary medium for education, entertainment, community interaction, and expression—not as permanent storage
22. Disclaimer of Warranties
THE H-O-M SOCIAL CLUB PLATFORM AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
• Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content on the Platform
• Any warranty that defects will be corrected or that the Platform will meet your requirements
Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the above exclusions apply to the greatest extent permitted by law.
23. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, H-O-M SOCIAL CLUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, CONTENT, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.
IN ALL CASES, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO YOUR USE OF THE PLATFORM OR THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO H-O-M SOCIAL CLUB DURING THE THREE (3) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Illustration of Liability Cap: If you are a free-tier user, the maximum liability cap is calculated as three (3) months multiplied by $0 (the amount paid for free service), resulting in a total maximum liability of $0.00. You expressly acknowledge and agree to this limitation as a material term of this Agreement.
The limitations in this section apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
24. BINDING ARBITRATION AND DISPUTE RESOLUTION
24.1 Agreement to Arbitrate
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN THROUGH COURT.
By using the H-O-M Social Club Platform, you and H-O-M Social Club agree that any and all disputes, claims, or controversies arising out of or relating to this Agreement, the Platform, or your use of the Service (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court. You expressly waive your right to bring a Dispute in court, including your right to a jury trial.
24.2 Arbitration Rules and Procedures
Arbitration shall be conducted by a mutually agreed-upon, nationally recognized arbitration organization (such as the American Arbitration Association (AAA) using its Consumer Arbitration Rules, or JAMS), under the rules in effect at the time the claim is filed, except as modified by this Agreement. If the parties cannot agree on an arbitration organization within 30 days, AAA rules shall apply.
The arbitration shall be conducted in English. The arbitrator shall have the authority to award any remedy available under applicable law, subject to the limitations set forth in this Agreement. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
24.3 Monetary Cap on Arbitration Awards
Notwithstanding any other provision, any monetary award in arbitration shall be limited to the maximum liability cap described in Section 23 above, which equals the total subscription fees you paid to H-O-M Social Club during the three (3) months immediately preceding the claim. This cap applies regardless of the nature of the claim, the theory of liability, or the outcome of the arbitration.
24.4 Class Action Waiver
YOU AND H-O-M SOCIAL CLUB EACH AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator shall have no authority to consolidate claims from multiple users or to award class-wide relief.
24.5 Exceptions
Notwithstanding the above, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to prevent irreparable harm pending arbitration. Such action shall not waive the right to arbitrate all other claims.
24.6 Jurisdiction-Specific Arbitration
For EU, UK, and other international users, where mandatory consumer protection laws require access to local courts or other dispute resolution mechanisms, those mandatory rights are not waived by this Agreement. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform. However, where arbitration is permitted, both parties agree it is the preferred and binding method of dispute resolution.
24.7 Governing Law
This Agreement and any Dispute shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. For users outside the United States, mandatory consumer protection laws of your country of residence may also apply and are not displaced by this Agreement to the extent prohibited by law.
25. Indemnification
You agree to defend, indemnify, and hold harmless H-O-M Social Club and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Platform; (b) your violation of this Agreement or any applicable law; (c) your User Content; (d) your violation of any third-party rights; or (e) any dispute between you and another user.
26. Third-Party Links and Services
The Platform may contain links to third-party websites, applications, or services. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to the applicable third-party terms and policies.
27. Modifications to the Agreement
We reserve the right to modify this Agreement at any time. We will notify you of material changes by updating the Effective Date and posting the revised Agreement on the Platform. For significant changes, we may provide additional notice via email or Platform notification. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Agreement. If you do not agree to the modifications, you must stop using the Platform.
28. Severability
If any provision of this Agreement is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from the remaining provisions, and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
29. Entire Agreement
This Agreement, together with our Community Standards, Cookie Policy, and any applicable subscription terms, constitutes the entire agreement between you and H-O-M Social Club with respect to the Platform and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
30. Waiver
Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. Any waiver of any right or provision shall be effective only if in writing and signed by an authorized representative of H-O-M Social Club.

ACKNOWLEDGMENT AND ACCEPTANCE
BY ACCESSING OR USING THE H-O-M SOCIAL CLUB PLATFORM, CREATING AN ACCOUNT, OR CLICKING “I AGREE,” YOU HEREBY ACKNOWLEDGE AND CONFIRM THAT:
• You have read this entire Agreement, including the Privacy Policy and Terms and Conditions, and fully understand its contents
• You are at least 18 years of age or the applicable age of majority in your jurisdiction
• You agree to be legally bound by all terms and conditions set forth in this Agreement
• You accept and agree to the binding arbitration provision and the limitation of liability cap
• You understand that the Platform is not intended as permanent data storage and you are solely responsible for your content
• You agree that H-O-M Social Club may remove your account, content, and data at its sole discretion without liability to you for data loss
• You understand and agree that your maximum recovery in any arbitration or legal proceeding shall not exceed the amount specified in Section 23
